State Rep Briel's (D) House Bill 4459 would create the Local Government Open Burn Permit Act. The measure allows any county or municipality to establish permit requirements for anyone seeking to perform an open burn. The permit may not be more than $5.
Huge fines for violations: “Provides for enforcement by a State's Attorney or the Attorney General, or a city attorney for ordinance violations authorized by the Act, and for a penalty of up to $100,000 for a person who conducts an open burn without a local government open burn permit, and a penalty of up to $500,000 for a person who conducts an open burn on a no burn day without a local government open burn permit”
Although the text of the bill filed does not go into detail of what constitutes a “Open burn” —- by definition an open burn is defined as any outdoor fire that releases smoke and combustion products directly into the air without passing through a chimney, stack, or enclosed incinerator. It includes burning materials in piles, barrels, pits, or for recreational purposes (campfires/bonfires). Common examples include burning yard waste, trash, or land-clearing debris.
Residential: Burning leaves, brush, tree limbs, or garden waste.
Recreational/Ceremonial: Campfires, bonfires, and use of portable outdoor fireplaces.
Agricultural/Disposal: Clearing land, burning agricultural waste, and more.
